AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement made between you ("you", "user", "customer") and [DirtyWix ] ("Company", "we", "us", "our"), concerning your access to and use of our website [dirtywix.com] (the "Site") and your purchase of goods from us.
By accessing the Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms. If you do not agree to all of these Terms, you are prohibited from using the Site and Service.

AGE RESTRICTION & ELIGIBILITY
You must be of the age of majority in your province or territory of residence (18 or 19 years of age, depending on the province) to purchase from this Site. By agreeing to these Terms, you represent and warrant that you are of legal age.
Our products, particularly intimate toys and wellness items, are intended for adult use only. You are solely responsible for ensuring that your use of any product complies with all applicable local, provincial, and federal laws.

INTELLECTUAL PROPERTY RIGHTS
All content on the Site (logos, text, graphics, images, software) is our property or the property of our licensors and is protected by Canadian and international copyright and intellectual property laws. We strive for accurate product displays, but we do not guarantee that colors, details, or descriptions are 100% accurate, complete, or error-free. We reserve the right to correct any errors and to change or update information at any time without notice.
We reserve the right to limit sales to any person, geographic region, or jurisdiction; and to limit the quantities of any products or services we offer. All descriptions and pricing are subject to change at any time without notice.

PURCHASES & PAYMENT
You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your information so we can complete your transactions and contact you as needed.
We use Shopify's secure payment processing. You agree to pay all charges at the prices in effect at the time of your order.

CRITICAL SALES TERMS FOR SPECIFIC GOODS

· Intimate & Hygiene-Sensitive Goods: All sales of intimate toys, lingerie, and similar hygiene-sensitive products are FINAL once the original manufacturer's packaging seal is broken, as detailed in our [Return & Refund Policy]. By purchasing these items, you explicitly waive any right of return or refund that might otherwise be implied by consumer protection law, except where required by law for proven manufacturer defects.
· Candles & Novelty Items: Candles are for decorative and aromatic use only. Burn responsibly and never leave unattended. "Cash Candles" are novelty items; finding cash or prizes is not guaranteed. We are not responsible for any outcome or use of these products contrary to their intended purpose.
· General: Products may have limited quantities and are subject to return or exchange only according to our Return & Refund Policy.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY CANADIAN LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
WE SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR DAMAGE OF ANY KIND ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED, INCLUDING BUT NOT LIMITED TO:

· Any direct, indirect, incidental, or consequential damages.
· Misuse of products, particularly intimate or novelty items.
· Any results from the use of "cash candles" (e.g., failure to find a prize).
· Errors or omissions on the Site.
  Our maximum cumulative liability to you for any claim related to the Service or products shall not exceed the purchase price of the product you purchased from us.

INDEMNIFICATION
You agree to indemnify and hold harmless [Dirtywix], its owners, directors, and employees from any claim or demand made by any third party due to or arising out of: (a) your breach of these Terms; (b) your use of the Site or products; or (c) your violation of any law or the rights of a third party.

GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts located in London Ontario.

CHANGES TO TERMS
We reserve the right to update, change, or replace any part of these Terms at any time by posting updates on the Site. It is your responsibility to check this page periodically for changes.
